The Worker, Homeownership and Business Assistance Act of 2009, extended and expanded the first-time homebuyer credit allowed by earlier Acts. To meet the revised deadline the purchaser must enter into a binding contract by April 30, 2010 with a closing date by June 30, 2010. First-time homebuyers are eligible to receive up to a $8,000 credit or 10% of the purchase price of the home. The revised act also allows long time homeowners (the same home for five consecutive years of the past eight years) buying a replacement principal residence to receive a credit up to $6,500 or 10% of the purchase price of the home. The first-time homebuyer credit has impacted first-time home purchasers; however, these are mostly home purchases that would have happened anyway.

The first-time homebuyer credit has many advantages and disadvantages. I have friends that were enticed to purchase a home now instead of waiting till they had a bigger down payment saved because of the first-time homebuyer credit. Some of my peers have used the money in the form of a down payment and others have received the money and purchased furniture or paid down existing credit card debt, etc. In terms of consumer spending extending the credit seems like a great idea. In my opinion, people see this as yet another way to receive free money. Have we not all learned by now that nothing is free. In 2008, home buyers were able to receive a $7,500 credit that had to be repaid.

But now that the $8,000 is free the housing market is speculated to harden. One must keep in mind the $8,000 tax credit also comes with a promissory note to make a monthly mortgage payment. Has anyone considered how much the tax credit will cost us in the future? The total cost of the tax credit has two components. The future increases in taxes to payback the monies that first-time homebuyers received as a tax credit and the potential economic cost of increased mortgage delinquencies. The program is estimated to cost $43,000 per buyer. The national average for mortgage delinquencies increased from approximately 10% as of September 30, 2009 from 8% in comparison to September 30, 2008. In addition, the national average for unemployment has increased from the third quarter of 2008 to 2009 by approximately 3%.

Instead of extending the current tax credit, I propose giving homebuyer credits to those that own a home who would like to trade up or even downsize without placing a five year restriction on receiving the tax credit. My husband and I purchased our first home in the summer of 2006. The former owners received approximately 27% net gain at settlement and owned the home for merely two years. We have now owned our home three and a half years and will be lucky to break even after settlement costs. Every mortgage payment has been paid on time and even extra principal payments have been made. We recently had our first child this past June and would like to move to a single home. However, we do not qualify for a homebuyer tax credit. Homebuyer tax credits are being handed to those who have never owned a home and to those who have owned a home for the past five years. For example, a homeowner could own their home for the past five years and decide to keep their current property as an investment property and still qualify for the first-time homebuyer credit.

Why should a person that is making timely payments on their current mortgage be excluded from receiving the homebuyer tax credit; merely due to the fact that the home doesn't meet the ownership criteria of being owned for the last five years out of the eight year period? In addition, I recommend going forward that the criteria for homebuyer programs be revised to include those that are current homebuyers with credit scores over seven hundred and fifty. However, for our economies sake, discontinuing the tax credit is in our best interest. The $8,000 tax credit per the reported 350,000 purchases (that would not have purchased if the tax credit was not available) will cost the nation approximately $16 billion. Personally, I am not interested in the nation incurring $16 billion more in debt in order to offer $8,000 or $6,500 tax credits. The $16 billion is more than double the amount that was originally anticipated when the stimulus package was signed in February 2009.
