27 Year Old Woman Dies Of Colon Cancer Due to Seven Month Delay In Her Diagnosis
Less than one percent people diagnosed with colon cancer are younger than 35. However, because of the deadly nature of the disease doctors generally acknowledge that rectal bleeding, even in a patient under 35, needs to be investigated by a colonoscopy so as to figure out if the bleeding is because of cancer or a different cause. Simply assuming that the blood is from hemorrhoids falls below the standard of care.
Take, for example, what occurred in a reported case involving a woman who complained to her primary care physician that she had blood in her stool and felt pain during bowel movements. She was only twenty four. The physician, justwithout even doing an examination, told her to take a laxative after deciding that she had diarrhea and other bowel issues. She went back after 4 months with complaints of constipation, pain and problems sitting. On this occasion the physician at last examined her yet told her she had hemorrhoids. His treatment: an enema. The woman went back to the doctor on 2 additional occassions and every time was reassured that she only had hemorrhoids and she had nothing to be concerned with.
The woman needed to be rushed to an emergency room because of extreme pain 7 months subsequent to her original trip to the family physician. They set her up for a colonoscopy and was found to have advanced colorectal cancer. The cancer was so extensive by the time she had surgery that not only did the surgeon need to take out a portion of her colon but in addition had to take out her uterus and a section of her lower intestines. This was followed by chemotherapy. The woman ultimately had a recurrence and passed away from the disease less than 3 years later. She was survived by her husband and daughter, a minor.
The law firm that handled this claim revealed that a jury awarded the family a sum of $2,500,000. The amount included $350,000 the largest amount allowed for pain and suffering under the law of the State where the doctor practices. The remainder of the award was for future lost wages. This case shows what is perhaps the most frequent medical mistake concerning a delay in the diagnosis of colon cancer.
Too often physicians do not perform a colonoscopy or refer the person to a specialist when a patient complains of rectal bleeding or blood in the stool. Rather, these physicians just assume that the blood is due to hemorrhoids. This is especially typical if the individual is less than fifty.
When a matter like the one described above happens and the patient passes away for the reason that the cancer progressed as a result of the delay in diagnosis the surviving family may be able to bring a claim against the doctor who caused the delay.
